Filing 86 OPINION & ORDER re: 77 MOTION to Dismiss the Amended Complaint filed by Gina Shibah, T. Grant, V. George, Raymond Ortiz, Lt. O'Cana, Richard Donahue, Angela Jackson, Todd Paroline. For the foregoing reasons, Defendants Moti on is granted in part and denied in part. Plaintiff's retaliation and due process claims against Jackson, Ortiz, Shi bah, Donahue, George, and O'Cana are dismissed with prejudice as time-barred and collaterally estopped. Plaintiff's retaliation claim against Grant is also dismissed, but, because this is the first adjudication of Plaintiff's claim against Grant on the merits, that claim is dismissed without prejudice. If Plaintiff wishes to file an Amended Complaint alleging additional facts and otherwise addressing the deficiencies identified above, Plaintiff must do so within 30 days of the date of this Opinion & Order. Plaintiff is advised that a second amended complaint would replace, and not supplement, the prior c omplaint. Accordingly, Plaintiff should include all allegations he wants to include against the Defendants remaining in this case. Defendants' Motion is denied as to the retaliation claims against Paroline. The Clerk of Court is respectfully directed to terminate the pending Motion, (Dkt. No. 77), and to mail a copy of this Opinion & Order to Plaintiff's address listed on the docket. SO ORDERED.
