OPINION re: 17 MOTION for Judgment on the Pleadings . filed by Carolyn W. Colvin, 14 FIRST MOTION for Judgment on the Pleadings . filed by Mario Saenz: Plaintiff Mario Saenz ("Saenz" or the "Plaintiff" ;) brings this action pursuant to Section 205 (g) of the Social Security Act, 42 U.S.C. § 402, et seq. (the "Act"), challenging the determination of Defendant Nancy Berryhill1, Acting Commissioner of Social Security ("Berryhill,&q uot; the "Defendant," or the "Commissioner"), to deny his application to the Social Security Administration ("SSA") for monthly disability insurance benefits ("DIB") and Supplemental Security Income ("SSI") benefits. Both parties have moved for judgment on the pleadings pursuant to Rule 12(c) of the Federal Rules of Civil Procedure.
