OPINION & ORDER re: 43 MOTION to Dismiss Plaintiff's Second Amended Complaint filed by Linda Schluter, Bedford Central School District, Gena Benz, Susan Ostrofsky, Susan Messina, Debra Jackson. For the foregoing reasons, P laintiffs federal claims are dismissed. Because this is the third iteration of the complaint, the dismissal is with prejudice. The state law claims are dismissed without prejudice. The Clerk of Court is respectfully directed to terminate the pending Motion, (see Dkt. No. 43), and close the case. (Signed by Judge Kenneth M.
