Filing 39 OPINION & ORDER re: 36 MOTION to Dismiss filed by Insperity, Inc., 30 MOTION to Dismiss filed by Zarti Group, LLC, Albert L. Sica, ALS Consulting, Inc. Acorn Advisors Group Holdings, LLP, The ALS Group, LLC. For the reasons stated above, Defendants' motions to dismiss are GRANTED. The claims for intentional infliction of emotional distress, tortious interference, and breach of the covenant of good faith and fair dealing are dismissed with prejudice. Insperity is dismissed as a Defendant with prejudice. The claim under CEPA as to the ALS Defendants is dismissed with leave to amend. Any Third Amended Complaint ("TAC") must be filed no later than October 25, 2018. If Plaintiff fails to f ile a TAC, the Clerk of Court shall close the case without further order of the Court.10 The Clerk of Court is respectfully directed to terminate the pending motions, (Docs. 30, 36), and to terminate Insperity from the case.
