Filing 23 DECISION AND ORDER: Defendants' motion to dismiss 11 plaintiffs' claim for failure to state a claim is denied. Further, the Court finds that plaintiffs Gregg Cunningham, Darius Hardwick and Christian Andzel lack standing to sue, and th ese plaintiffs are dismissed from the action without prejudice. The Clerk of the Court shall take the steps necessary to terminate these plaintiffs. The Court follows the Report and Recommendation 18 for the reasons stated in the attached Decision and Order.
