Filing 9 Text Order:On January 28, 2021, the plaintiffs moved, in two pending federal cases, to dismiss their Equal Protection claims under Rule 41(a)(2) and to remand the remaining state law claims to state court. Case No. 21-CV-142, Docket Number [6-1]; Case No. 21-CV-132, Docket Item 5. On January 29, 2021, the defendants responded. Case No. 21-CV-142, Docket Number #7 ; Case No. 21-CV-132, Docket Item 6. On February 1, 2021, the Court heard oral argument and proposed the following disposition to which both parties agreed and which the Court now orders.The plaintiffs' notice of voluntary dismissal without prejudice in Case No. 21-CV-132 is SO ORDERED.The Court construes the plaintiffs' motion to dismiss in 21-CV-142 as a motion to amend the complaint under Rule 15 by withdrawing the Equal Protection claim. See Smith v. Artus, 522 F. App'x 82, 84 n.2 (2d Cir. 2013) ("Although the District Court analyzed Smith's request based on Rule 41(a)(2) of the Federal Rules of Civil Procedure, a plaintiff's request to withdraw some but not all of his claims is properly considered as an amendment to the pleadings based on Rule 15(a)(2)."). The motion to amend is GRANTED and the plaintiffs' Equal Protection claim therefore is withdrawn. Because state law claims are all that remain, the Court REMANDS the matter to the New York Supreme Court, Erie County, without prejudice, so that the plaintiffs may pursue their state law claims there. Under 28 U.S.C. 1367(c)(3), "district courts may decline to exercise supplemental jurisdiction over a claim" if "the district court has dismissed all claims over which it has original jurisdiction." In deciding whether to retain supplemental jurisdiction over state law claims, a court should "consider factors such as judicial economy, convenience, fairness, and comity." Nowak v. Ironworkers Local 6 Pension Fund, 81 F.3d 1182, 1191 (2d Cir. 1996). Moreover, "[n]eedless decisions of state law [by a federal court] should be avoided both as a matter of comity and to promote justice between the parties, by procuring for them a surer-footed reading of applicable law." See Kolari v. New York-Presbyterian Hosp., 455 F.3d 118, 122 (2d Cir. 2006) (quoting United Mine Workers v. Gibbs, 383 U.S. 715, 726 (1966)). Because this matter is still in the very early stages of litigation and only state law claims remain, remanding this matter promotes each of the factors listed above. The plaintiffs' motion to remand therefore is GRANTED, and the matter is remanded, without prejudice, to the New York Supreme Court, Erie County. The Clerk of the Court shall close this file.
