DECISION AND ORDER granting in part and denying in part 8 Motion to Dismiss for Failure to State a Claim; denying 23 Motion to Strike 8 MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM re: Plaintiff's Second, Third, and Fourth Causes of A ction Pursuant to Fed.R.Civ.P. 12(b)(6), 14 MOTION to Amend/Correct Complaint, 23 MOTION to Strike Argument Section IA of Plaintiff's Reply in Further Support of its Motion for Leave to Amend Pursuant to Local Rule 7(a)(6) MOTION to Strike Argument Section IA of Plaintiff's Reply in Further Support of its Motion for Leave to Amend Pursuant to Local Rule 7(a)(6). The Amended Complaint [#14-3] is now the operative pleading, although its third and fourth cause s of action are stricken for the reasons discussed herein. Presently, there are two claims in the action: breach of contract and misappropriation of trade secrets. Defendant is ordered to answer or otherwise move against the Amended Complaint within twenty (20) days of the date of this Decision and Order, unless the parties stipulate otherwise.. Signed by Hon.
