ORDER denying without prejudice 10 Motion for Summary Judgment filed on behalf of Defendants Artus, Bedard, and Hume. Pursuant to 28 U.S.C. § 1915(e)(2)(B), Plaintiff's claim against Defendant Olles is dismissed. Plaintiffs First Amendm ent claims against Defendants Schuck and Sippel, as well as Plaintiffs due process claims against Defendants Artus, Bedard, and Hume, may proceed. The Clerk of Court is directed to cause the United States Marshals Service to serve copies of the Summons, Amended Complaint, and this Order upon Defendants Schuck and Sippel.
