April 9, 2019 Opinion or Order Filing 40 JUDGMENT - For the reasons set forth in an order granting the United States' Motion for Sanctions, and in consideration of the default judgment entered against the Guy Family Trust and TCJ Investments, Inc., the Court her eby ORDERS, ADJUDGES, AND DECREES that: As a sanction against Guy, by reason of the following tax assessments, Neill Guy is indebted to the United States for unpaid federal income taxes, interest, and penalties in the total amount of $13,086.86, and $19,122,748.89 as of September 25, 2017, plus interest and costs that have accrued after that date and will continue to accrue according to law. As a sanction against Guy, the Court finds that the Guy Family Trust and TCJ are alter egos of Neill Guy, and the United States should be authorized to collect his federal tax liabilities from those entities. As a sanction against Guy, the United States is authorized to collect the unpaid tax liabilities of Neill Guy from him individually as w ell as the Guy Family Trust and TCJ Investments, Inc. January 9, 2019 Opinion or Order Filing 33 ORDER granting 32 Motion to Compel - The court hereby ORDERS that Neill P. Guy file responses to the United States' First Set of Interrogatories and First Set of Requests for Production no later than fourteen days from the date of the entry of this Order, with such responses to be served on counsel for the United States by email as well as by first-class mail; and further ORDERS that all discovery shall be commenced or served in time to be completed by June 1, 201 9. All potentially dispositive motions shall be filed by plaintiff and defendant Cumberland County, North Carolina by July 3, 2019. Defendants may oppose and (to the extent desired) cross-move against the United States or Cumberland County by July 17, 2019. Plaintiff and Cumberland County may then reply (and, to the extent necessary) oppose the cross-motion(s) by August 1, 2019.
