Filing 28 ORDER granting in part and denying in part 22 Motion for Summary Judgment - Defendant's motion for summary judgment as to breach of contract is DENIED. Defendant's motion for summary judgment regarding bad faith, unfair and deceptive tra de practices, attorney's fees, treble damages and consequential damages is GRANTED. Plaintiffs' breach of contract claim and defendant's counterclaims remain for trial. With regard to the case management order issued September 5, 2012, specifying pretrial activities and necessary trial preparation, the parties are directed to file a joint statement setting forth proposed alternative dates for trial, which statement shall reflect consideration also of whether further settlement activities may be appropriate and if so, timing of same.
