June 28, 2010 Opinion or Order Filing 22 MEMORANDUM OPINION, ORDER, AND RECOMMENDATION that, in Case No. 1:07CV326, except as to Plaintiff's claim regarding the decision to place him in solitary confinement on March 5, 2007, Defendant Shoaf's Motion for Summary Judgment (Docket En try 16 ) be GRANTED to the extent it relies on Plaintiff's failure to exhaust administrative remedies and that, as to those claims, this action be DISMISSED WITHOUT PREJUDICE to re-filing if and when Plaintiff exhausts his administrative remedi es as to said claims. IT IS FURTHER RECOMMENDED that, in Case No. 1:07CV326, as to Plaintiff's claim regarding the decision to place him in solitary confinement on March 5, 2007, Defendant Shoaf's Motion for Summary Judgment (Docket Entry [ 16]) be GRANTED based on the doctrine of qualified immunity and that said claim be DISMISSED WITH PREJUDICE. IT IS FURTHER ORDERED that, in Case No. 1:07CV326, Defendant Shoaf's Motion to Strike (Docket Entry 20 ) is DENIED AS MOOT. IT IS FURTH ER RECOMMENDED that, in Case No. 1:07CV327, Defendant Grices Motion for Summary Judgment (Docket Entry 19) be GRANTED based on the doctrine of qualified immunity and that Plaintiff's action be DISMISSED WITH PREJUDICE. IT IS FURTHER ORDERED that, in Case No. 1:07CV327, Defendant Grice's Motion to Strike (Docket Entry 23 ) is DENIED AS MOOT signed by MAG/JUDGE L. PATRICK AULD on 6/28/2010. (Wilson, JoAnne)
