If the court adopts the recommendation of dismissal, Defendant Deutsche Bank's motion to stri ke Plaintiff's first request for production of documents, admissions, and written interrogatories (docket no. 39 ) and Plaintiff's motion for entry of default as to Defendant Deutsche Bank (docket no. 16 ) will be rendered moot.
