It is FURTHER RECOMMENDED that the Certification Motion (Docket Entry 52 ) be granted in part and denied in pa rt as follows: an FDCPA Class consisting of "all consumers throughout the State of North Carolina whose servicing rights were acquired by Defendantwhen their loan was in default and who were sent a letter fromDefendant substantially similar or materially identical to the NCFinal Letter delivered to Plaintiffs" be certified with Smith asthe named plaintiff.
