MEMORANDUM OPINION AND ORDER signed by JUDGE LORETTA C. BIGGS on 1/11/2019. For the reasons stated herein, Defendant's Motion to Dismiss, (ECF No. 23 ), is DENIED. FURTHER that Plaintiff's Motion for Volu ntary Dismissal, (ECF No. 28 ), is GRANTED, subject to the condition that Plaintiff pay Defendants' reasonable taxable costs associated with this matter. FURTHER that the costs of this action are taxed against the Plaintiff. Defendants shall submit an itemized bill of costs within fourteen (14) days of the entry of this Order. (Daniel, J)
