TEXT RECOMMENDATION that the Court dismiss this action as frivolous under 28 U.S.C. s 1915(e)(2)(B), in light of the obvious lack of subject matter jurisdiction. According to #2 Complaint, Plaintiff has purported to invoke federal question jurisdiction; however, as the basis for that invocation, #2 Complaint states only, "[b]ased on North Carolina state statute, [i]t is illegal to issue consumers APR rates of 24% [but] mine is 30%." An alleged violation of a state statute does not create a federal question. Moreover, nothing in the "Statement of Claim" or "Relief" portions of #2 Complaint identifies any federal question. Finally, although #3 Civil Cover Sheet reflects a check-mark beside "Truth in Lending" within the "Nature of Suit" subsection, nothing in #2 Complaint provides any basis to conclude that Plaintiff actually has attempted to state a claim under that federal statute (or could do so).
