Plaintiff's 18 Amended Complaint survives initial review on the claims of deprivations of free speech and due process but all other claims are dismissed pursuant to 28 U.S.C. § 1915(e)(ii). 2. Plaintif f's 19 "Motion for Judgment," is construed as a motion for summary judgment and is DENIED without prejudice as premature. 3. The Clerk of Court shall commence the procedure for waiver of service as set forth in Local Rule 4.3 for Defendants Hooks, Guice, Mitchell, and Hernandez who are current or former employees of NC DPS.
