Memorandum Opinion: Petitioner's objections (Doc. No. 13 ) to the Report and Recommendation (Doc. No. 12 ) are overruled. The Court accepts the findings in the Report and Recommendation, and specifically accepts the ultimate conclusion that the petition should be denied. The petition for writ of habeas corpus (Doc. No. 1 ) is denied and this case will be dismissed with prejudice. Further, the Court certifies that an appeal from this decision could not be taken in good faith and that there is no basis upon which to issue a certificate of appealability.
