Memorandum Opinion and Order: Pamela Hogan is dismissed from this action for lack of subject matter jurisdiction. Eric Hogan is granted judgment on the pleadings as to all claims asserted against him with the exception of the negligent misrep resentation claim, asserted as Count VII, for which dismissal was not sought. P & E is granted judgment on the pleadings as to the fraud claim, asserted as Count VI. Hartford is granted summary judgment as to the Miller Act claim. Because this was the only claim asserted against Hartford, it too is dismissed from this action. re 13 21 14 15 Judge Jeffrey J. Helmick on 3/14/2019. (S,AL)
