Memorandum Opinion and Order. For the reasons set forth herein, Plaintiffs' renewed motion for class certification is denied (Doc. No. 155 ). In view of the ruling herein denying class certification, supplementation of plaintiffs' expert report is not necessary; the original report already contains the expert's damages calculations for the named plaintiffs. Memorandum Opinion and Order: For the reasons set forth herein, defendant's motion for summary judgment (Doc. No. 136 ) is granted. In view of this ruling, the Court directs counsel to confer and to propose in writing by November 8, 20 17, their joint suggestions as to how to proceed with the case, including re-briefing on the question of class certification; whether any additional discovery is required; whether another round of summary judgment motions would be helpful and/or warr anted; whether there is any interest in attempting to resolve the case and, if so, by what means; and any other matter counsel would like to bring to this Court's attention. The Court will then conduct a telephone conference, with counsel only, on November 14, 2017 at 12:30 p.m. Plaintiffs' counsel shall be responsible for placing the call to the Court's chambers after all counsel are on the line. Order: After the discussion held with counsel on 3/12/2015, the Court concludes that the motions for summary judgment (Doc. Nos. 114 and 118 ) should be, and hereby are, administratively denied, without prejudice to renewal at an appropriat e time. Further, the Court directs counsel to confer in good faith and to propose a draft order certifying the appropriate question(s) to the Ohio Supreme Court, taking care to frame the issues in a balanced and neutral way, and to conform the draft order to the directives of Rule of Practice XVIII. The order, in Word format, shall be emailed to the Court's law clerk by no later than noon on Friday, March 20, 2015.
