Memorandum of Opinion and Order Plaintiff's 2 Motion to Proceed in forma pauperis is granted but, for the reasons set forth herein, this action is dismissed pursuant to 28 U.S.C. §§ 1915(e)(2)(B) and 1915A. The Court c ertifies, pursuant to 28 U.S.C. §1915(a)(3), that an appeal from this decision could not be taken in good faith. Plaintiff's 5 Motion to Amend is denied, and his pending Motions for assistance in obtaining counsel and for appointment of counsel (ECF Nos. 3 , 4 ) are denied as moot. Judge Benita Y.
