October 15, 2010	Filing 8 Memorandum Opinion and Order: This action is dismissed with prejudice pursuant to 28 U.S.C. Section 1915(e)(2). The Court certifies, pursuant to 28 U.S.C. Section 1915(a)(3), that an appeal from this decision could not be taken in good faith. Because the federal claims against Defendant are dismissed, the pendent state claim for intentional infliction of emotional distress should be dismissed as well. Since the Court has granted judgment on the federal claims, the state pendent claim is hereby dismissed pursuant to 28 U.S.C. Section 1367(c)(3). Judge Sara Lioi on 10/15/2010. (P,J)
