Memorandum of Opinion and Order For the reasons set forth herein, Defendants' Motion for Summary Judgment (ECF No. 50 ) is granted in part. Defendants' motion is granted as to Plaintiff's claims for (1) violation of the FLSA (Count IX) regarding attorney's fees for his FLSA wage claim before the DOL only, and (2) intentional infliction of emotional distress (Count XII). Plaintiff's Motion for Partial Summary Judgment as to Counts IV, V, VI, and IX of the Complaint (ECF No. 51 ) is denied. Judge Benita Y. Pearson on 5/10/2018. (JLG)
