Filing 4 Memorandum Opinion and Order: For the reasons set forth herein, this case is dismissed pursuant to Fed. R. Civ. P. 12(h)(3) for lack of subject matter jurisdiction. This dismissal is without prejudice, and plaintiff may refile the claims brought herein in state court or federal court if plaintiff can allege facts which would support a determination of federal subject matter jurisdiction. Plaintiff's motion to proceed in forma pauperis is granted (Doc. No. #2 ). The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that an appeal from this decision could not be taken in good faith.
