Plaintiff's medical negligence/malpractice c laim against defendant Jones should be dismissed in its entirety, as should plaintiff's wrongful death claim against Jones, and plaintiffs wrongful death claim against defendant Jones in his individual capacity should remain at this stage of the litigation. Plaintiff's motion to amend her complaint (Doc. 12) should be conditionally GRANTED. An Amended Complaint must be filed by 8/30/13 Objections to R&R due by 9/6/2013.
