ORDER that Plaintiffs motion for preliminary injunction and expedited discovery 2 is GRANTED IN PART and DENIED IN PART. Plaintiffs request for a preliminary injunction is DENIED. Plaintiffs unopposed request for expedited discovery is GRANTED. The parties may conduct expedited, reciprocal discovery to the extent they agree on discoverable information.Defendants motion for prediscovery identification of trade secrets 13 is GRANTED IN PART. Defendants request that P laintiff be required to submit a specific, narrative list of allegedly misappropriated trade secrets prior to discovery is GRANTED to the extent that Defendant need not disclose any information relating to its own trade secrets until Plaintiff has identified its own trade secrets. However, Defendant must engage in good faith discovery that is not related to its own trade secrets forthwith. Plaintiffs identification of the trade secrets at issue in this case may only occur after the partie s have been granted a Protective Order. The Court anticipates that an agreed Protective Order is forthcoming (see 12/15/17 Notation Order). Plaintiffs motion for leave to file instater surreply brief in opposition to Defendants motion for prediscovery identification of trade secrets 22 is DENIED AS MOOT.Signed by Judge Timothy S.
