NOTATION ORDER: This matter is before the Court on Petitioner's Voluntary Dismissal as to all Defendants, pursuant to Fed. Civ. R. Pro. 41(a)(1)(A). Petitioner represents that no defendant has filed an answer. However, Respondent Richard K. Jones, Sheriff, has filed an answer. Nevertheless, because no other respondent has filed an answer, the answer deadline has passed, and Respondent Jones did not file a counterclaim, the Court finds good cause under Rule 41(a)(2) and thereby DISMISSES this action without prejudice.
