ORDER and REPORT AND RECOMMENDATION: With respect to Plaintiff's Eighth Amendment medical indifference claim, it is RECOMMENDED that the Court GRANT Defendants' 34 Motion for Summary Judgment. To the extent Plaintiff intend ed to assert a state-law medical malpractice claim, it is further RECOMMENDED that the Court decline to exercise supplemental jurisdiction under 28 U.S.C. § 1367(c)(3) over any such state-law claim and that the Court DISMISS any su ch claim without prejudice to Plaintiff asserting such a claim in state court.
