Filing 37 ORDER - Accordingly, based on the foregoing this Court GRANTS the following relief: l. A declaratory order finding Huber to be in violation of the terms and conditions of the Local Union's Collective Bargaining Agreement by failing to pay requir ed amounts to the Union on behalf of bargaining unit employees ("Dues"). 2. A declaratory order finding Huber to be in violation of the Trust Agreements for failing to timely submit employer and employee fringe benefit contributions to the Trusts. 3. A monetary judgment against Huber in the amount of$280,095.83, in unpaid Dues known to be owed to the Union and delinquent fringe benefits, interest, and liquidated damages known to be owed to the Trusts. 4. A monetary judgment agai nst Huber pursuant to Section 502(g)(2)(D) of ERISA, 29 U.S.C. § 1132(g)(2)(D) in the amount of $4,031.25, which represents Plaintiffs' reasonable attorneys' fees and costs incurred in pursuing this Case. granting 36 Motion for Default Judgment. Filing 13 ORDER granting 11 Motion for Default Judgment - This Court GRANTS the following relief: 1. A declaratory order finding Defendants are in violation of the Local 44 CBA due to their failure to timely submit required Dues to Plaintiff Iron Workers L ocal Union No. 44. 2. A monetary judgment in favor of Plaintiff Iron Workers Local Union No. 44 and against Defendants, jointly and severally, in the amount of $132,416.48, with said amount representing all known unpaid Dues and prejudgment int erest found due and owing to the Plaintiff through April 30, 2018. 3. A declaratory judgment requiring Defendants to immediately pay all delinquent Dues owed for any unreported employer remittance reports, along with any additional unpaid amounts f ound to be owed on any unreported or incomplete remittance reports. 4. Post-judgment interest on all monetary relief granted herein pursuant to 28 U.S.C.§ 1961. 5. Such other legal or equitable relief as this Court deems appropriate. Signed by Judge Walter H.
