ORDER granting 34 Defendant Comanche County Memorial Hospital's Motion to Dismiss as follows: 1) The Court dismisses plaintiff's § 1983 claim against CCMH without prejudice and grants plaintiff leave to file a Second Amended Complain t. Plaintiff shall have seven (7) days from the date of this Order to file a Second Amended Complaint; and 2) The Court dismisses plaintiff's IIED claim against CCMH (as more fully set out in order).
