OPINION AND ORDER: Defendants Motion to Dismiss 14 , is granted and plaintiffs second claim for relief is dismissed. Defendant is directed to file an answer to the remaining claim in the Second Amended Complaint by December 3, 2017. Should Plaintiff learn of additional facts to support a claim for age discrimination based on disparate impact, the Court will consider a properly supported motion to amend the complaint.
