St. Timothy's Episcopal Church et al v. City of Brookings Featured Case

Plaintiffs St. Timothy's Episcopal Church and Reverend James Bernard Lindley sued Defendant City of Brookings after the city adopted an ordinance that required area churches to apply for conditional use permits to offer benevolent meal services. The city also conditioned issuance of the permit on an agreement not to serve more than two meals per week. Plaintiffs alleged that the city's actions violate the Religious Land Use and Institutionalized Persons Act, and infringed and threaten to infringe Plaintiffs' state and federal constitutional rights to free religious exercise and free speech because the provision of meals is a critical expression of the congregants' Christian faith.
