ORDER: As a choice of law question, I find that Oregons statute of repose applies to this dispute. New York law would apply that statute and New Yorks interest is entitled to greater weight than the interest of California under the circumstan ces of this case. The next question, yet to be briefed, is whether that conclusion means defendants are entitled to summary judgment. Plaintiffs response brief on that point is due January 11, 2012.
