Opinion and Order - Dooney's Motion for Summary Judgment (Dkt. 35 ) is granted in part and denied in part. Defendant's motion for summary judgment against Plaintiff's Additional Nordstrom Commissions claim (Plaintiff's First Clai m for Relief, Wage Claim Part One) is granted. Defendant's motion for summary judgment against Plaintiff's Nordstrom Rack claim (Plaintiff's First Claim for Relief, Wage Claim Part Two) is granted in part and denied in part as follows: Plaintiff's Nordstrom Rack claim may proceed only with regard to Plaintiff's claim for the first month's commission earned in February 2009 relating to shipments made to the Nordstrom Rack. Defendant's motion for summary judgment against Plaintiff's Second Claim for Relief (statutory penalty) is denied.
