Columbia's Motion to Dismiss 80 is GRANTED in part. However, the dismissal is granted without prejudice and with le ave to amend with respect to the claims of fraud, negligent misrepresentation, and breach of the obligation of good faith and fair dealing. The dismissal is granted with prejudice with respect to the claims of breach of contract and promissory estoppel.
