On § 31105(a)(1)(B)(ii) claim, the Court DENIES Old Dominion's Motion for Summary Judgment. On Bauer's claims for punitive damages under state and federal law, the Court DENIES Old Dominion's motion for s ummary judgment. Old Dominion's Motion for Summary Judgment (ECF 97 ) is GRANTED in part and DENIED in part. Bauer's Motion for Partial Summary Judgment (ECF 114 ) is DENIED.
