FINDINGS OF FACT AND CONCLUSIONS OF LAW. The Court construes Plaintiff's and Defendant's motions for summary judgment (ECF Nos. 23 and 24 ) as motions for judgment pursuant to FED. R. CIV. P. 52(a). The Court DENIES Defendant 9;s motion for judgment (ECF No. 23 ) and GRANTS Plaintiff's motion for judgment (ECF No. 24 ). The Court DECLARES that Plaintiff is entitled to LTD benefits under the terms of the Plan. The parties shall meet and confer to address the specifi c amount of back benefits and the applicable interest rate, as well as a reasonable attorney fee and cost award. The parties shall submit a stipulated proposed form of judgment. If the parties are unable to reach agreement on these issues within 30 days of this Order, Plaintiff shall file a motion setting forth any issues that remain to be resolved by the Court.
