Additionally, Kishna's application to proceed in forma pauperis (ECF No. #1 ) should be GRANTED and her motion for appointment of counsel (ECF No. #3 ) should be DENIED. Scheduling Order The Findings and Recommendation will be referred to a district judge. Objections, if any, are due within 14 days. If no objections are filed, then the Findings and Recommendation will go under advisement on that date. If objections are filed, then a response is due within 14 days after being served with a copy of the objections. When the response is due or filed, whichever date is earlier, the Findings and Recommendation will go under advisement. February 9, 2022 Opinion or Order Filing 5 ORDER TO AMEND: Based on the foregoing, Plaintiff is Ordered to file an AMENDED COMPLAINT within 30 days of the date of this ORDER. Plaintiff is advised that failure to file an Amended Complaint within 30 days may result in dismissal of this action without prejudice. Plaintiff is advised that the amended complaint will serve as a complete substitute for the original, and not as a supplement. See Rhodes v. Robinson, 621 F.3d 1002, 1005 (9th Cir. 2010) (explaining that [a]s a general rule, when a plaintiff files an amended complaint, [t]he amended complaint super[s]edes the original, the latter being treated thereafter as non-existent) (quoting Loux v. Rhay, 375 F.2d 55, 57 (9th Cir. 1967)). Plaintiff should also take care to ensure the amended complaint is readable, names a defendant or defendants, specifies the basis for jurisdiction, and captions and numbers her claims clearly.
