Because Carter was incarcerated when he filed this case but has now been released from custody, in order to be granted leave to proceed in forma pauperis he is required to make a partial payment of the $350 filing fee to the Clerk of Court. He is ORDERED to, within thirty (30) days of the date of this Order, submit an initial partial filing fee of $38.31 to the Clerk of Court if he wants to proceed with this case. Carters Motion for Leave to Proceed In Forma Pauperis (ECF No. 3) is DENIED WITHOUT PREJUDICE to Carters right to file a new motion for leave to proceed in forma pauperis as set forth in this Order along with an initial partial filing fee of $38.31. The Clerk of Court is DIRECTED to provide Carter with an appropriate non-prisoner application to proceed in forma pauperis, bearing the civil action number of this case. Carter may use this form to seek leave to proceed in forma pauperis if he cannot afford to pay the remainder of the filing fee to commence this case.
