October 2, 2009 Opinion or Order Filing 32 MEMORANDUM AND ORDER: (1) Pltf West Virginia University Hospitals Mtn forPI, 5 , is GRANTED;(2) Dfts Edward G. Rendell, Estelle B. Richman, and Michael Nardone, and each of their officials, employees, agents and assigns, are hereby ENJOINED from dis tributing trauma disproportionate share hospital (Trauma DSH) payments to any eligible provider pursuant to the Trauma Systems Stabilization Act, 35 Pa. Cons. Stat. Ann. §§ 6943.1 et seq., and Pennsylvania State Plan Amendment #09-003, that part of the Pennsylvania State Plan under Title XIX of the Social Security Act establishing a class of disproportionate share payments tobe distributed to hospitals accredited as trauma centers by the Pennsylvania Trauma Systems Foundation, until fu rther order of court;(3) This order shall take effect as soon as Pltf posts a bond of five hundreddollars and zero cents ($500.00) with the clerk of court for the US District Court for the MD of PA, which amount this court deems sufficient to pa y the costs and damages sustained by Dfts should they be found to have been wrongfully enjoined or restrained.IT IS FURTHER ORDERED THAT a scheduling conference will beconducted by the court on 10/2809 at 10:30 a.m. In the interest of economy, the co urt prefers to hold this conference by telephone.
