MEMORANDUM AND ORDER granting in part and denying in part 100 Motion for Judgment as a Matter of Law, Motion for New Trial, Motion to Alter Judgment; finding as moot 101 Motion to Stay. IT IS HEREBY ORDERED that:(1) Defendants Motion for Judgmen t as a Matter of Law, Motion for a New Trial, and Motion to Alter Judgement (Doc. 100) is GRANTED IN PART and DENIED IN PART as follows:(a)Defendants motion for judgment as a matter of law on punitive damages is GRANTED, and the portion of the judgme nt (Doc. 95) awarding punitive damages is VACATED.(b)Defendants motion for a remittitur is GRANTED. The Plaintiff shall REMIT $100,000 of the compensatory damage award. Should the Plaintiff refuse to accept $50,000 in compensatory damages , a new trial on the issue of compensatory damages shall be conducted.(c)As to the reminder, the motion is DENIED.(2) Defendants Motion to Stay Proceedings to Enforce Judgment Pending Disposition of Post Trial Motions is DENIED AS MOOT.
