MEMORANDUM and OPINION - For the foregoing reasons, the Court will grant Defendant's Motion for Summary Judgment with respect to Plaintiff's claim of fraud in the inducement but will deny with respect to Defendants' counterclaim for eq uitable extension of the lease. Further, the Court will grant summary judgment sua sponte in favor of Plaintiff on Defendant's counterclaim.Defendant's request for oral argument (Doc. 50) is denied as moot.
