Filing 56 ORDER. Defendant THOMAS DOERR'S Motion to Dismiss (Doc. 49 ) is DENIED. Plaintiff's Third Amended Complaint sufficiently alleges Defendant THOMAS DOERR participated in discrete discriminatory acts to allow Plaintiff's Fourteenth Ame ndment sex discrimination claim to proceed. Pursuant to the stipulation at Doc. 48 and Federal Rule of Civil Procedure 12(a)(4), all Defendants in this action must Answer within 14 days of this Order. Signed by Judge Cathy Bissoon on 10/4/18. Filing 42 ORDER. For the reasons in the filing at this docket entry, Defendants' Motions to Dismiss (Docs. 22 and 25 ) will be GRANTED in part and DENIED in part. Plaintiff's Fourteenth Amendment Gender Discrimination claim will be dismissed wit hout prejudice to the extent that Plaintiff claims that Doerr's discrete discriminatory acts form the basis of it; Plaintiff's Procedural Due Process claim will be dismissed with prejudice. Plaintiff's deadline for filing an amended c omplaint, if Plaintiff wishes to do so, shall be August 3, 2018. This will be Plaintiff's final opportunity to amend her gender discrimination claim. If Plaintiff does not file an amended complaint by August 3, 2018, Plaintiff's gender di scrimination claim, to the extent that Plaintiff claims Doerr's discrete act forms the basis of it, will be dismissed with prejudice. Defendants' Motions to Dismiss will be DENIED as to all remaining claims. IT IS FURTHER ORDERED that Plaintiff's Motion to Strike (Doc. 40 ) is denied as moot.
