February 21, 2019 Opinion or Order Filing 15 AMENDED ORDER. The Court's Order of February 20, 2019 (Doc. 12 ) is hereby amended as follows. Plaintiff's Motion for a Temporary Restraining Order ("TRO") (Doc. #3 ) is DENIED in part, as Plaintiff fails to meet the requirements of Rule 65(b). Specifically, and particularly given that Defendant has been personally served (see Docs. #11 , #14 ), there is an insufficient basis for granting the motion without providing Defendant with prior notice and an opportunity to be heard at a hearing. However, the Court will consider Doc. #3 to the extent it requests a preliminary injunction and will analyze all remaining requests and motions under the appropriate standards once a preliminary injunction hearing is scheduled. At the request of Plaintiff's counsel, the Telephonic Status Conference regarding the pending motions previously set for 2/25/2019 at 3:00 PM is RESCHEDULED to 2/22/2019 at 11:15 AM before Judge Cathy Bissoon. All participants shall contact the undersigned's Chambers at (412) 208-7460 on a single telephone line, and Plaintiff's counsel shall coordinate the call. To the extent practicable, counsel for Plaintiff shall provide notice of this telephone conference to Defendant and secure his participation, and Plaintiff shall also notify Defendant of the change in schedule.
