ORDER. Defendant's motion to dismiss (ECF #4 ) is hereby held in abeyance. In light of footnote 2 in Plaintiff's brief in opposition (ECF #7 ), counsel are hereby ordered to confer in good faith as to whether all or part of the motion can be resolved by agreement. By March 23, 2021, counsel shall file a joint notice, informing the Court whether any aspects of the motion to dismiss are withdrawn, whether Plaintiff intends to file an amended complaint to cure any alleged defects, or whether the parties intend to rest on their briefs. If the parties cannot resolve or cure the issues presented by the motion, and in light of the new arguments raised in Defendant's reply brief, Plaintiff is granted leave to file a surreply by March 30, 2021.
