February 22, 2021 Opinion or Order Filing 2 ORDER Granting Motion to Proceed In Forma Pauperis, Staying the Action and Administratively Closing the Case, Without Prejudice. The Motion to Proceed In Forma Pauperis #1 is granted. Upon examination of the Complaint pursuant to 28 U.S.C. 1915, the Court notes that there are two (2) plaintiffs, one an individual and the other an LLC. The same individual plaintiff purports to represent each. The record does not reflect that such individual is a member of the Bar of this Court, or is a lawyer at all. The LLC Defendant cannot appear pro se, and may not be represented in this Court by a non-lawyer. Murray v. City of Philadelphia, 901 F. 3d 169, 170 (3d Cir. 2018); Simbraw, Inc. v. United States, 367 F. 2d 373, 374 (3d Cir. 1966); see Rowland v. California Men's Colony, 506 U.S. 194, 201-02 (1993). Consequently, this action may not proceed further at this time. The action will be stayed pending further Order, and pending the LLC plaintiff obtaining representation by legal counsel, who shall promptly file a notice of appearance on the docket. The action will be administratively CLOSED without prejudice pending such occurring. The individual plaintiff, and counsel for the LLC plaintiff, may move to lift the stay when such entry of appearance has been made. Signed by Chief Judge Mark R. Hornak on 2/22/21.
