MEMORANDUM ORDER: The Court agrees with the thorough and well-reasoned analysis set forth in Judge Dodges Report and Recommendation 112 , and the Court accepts and adopts Judge Dodges Report and Recommendation in its entirety as the opinion of the C ourt with respect to Defendants Motion to Dismiss Plaintiffs Second Amended Complaint. Plaintiffs objections 115 to the Report and Recommendation are overruled. It is hereby further ORDERED that Defendants Motion to Dismiss Plaintiffs Second Amende d Complaint 98 is granted, and Plaintiffs Second Amended Complaint 94 is dismissed with prejudice. Plaintiffs Letter Motion to Expedite 116 is denied as moot. It is hereby further ORDERED that, pursuant to Rule 4(a)(1) of the Federal Rules of A ppellate Procedure, if any party wishes to appeal from this Order, a notice of appeal, as provided in Fed. R. App. P. 3, must be filed with the Clerk of Court, United States District Court, at 700 Grant Street, Room 3110, Pittsburgh, PA 15219, within thirty (30) days.
