TRANSFER ORDER: On July 6, 2021, pro se petitioner Kevin Williams, presently incarcerated at the State Correctional Institution-Forest in Marienville, Pennsylvania, commenced this action titled Supplemental Amendment to Writ of Mandamus, seeking to compel action on his petitions for a writ of habeas corpus filed in Pennsylvania and immediate release from custody of the Pennsylvania Department of Corrections. (See ECF No. 1, Petition at p. 10.) The Court liberally construes petitioner's application as seeking habeas corpus relief. This court is not the proper court in which to seek such relief. See 28 U.S.C. 2241(a) (providing federal courts with power to grant a writ of habeas corpus only within their respective jurisdictions.). This requirement is jurisdictional. See Rumsfeld v. Padilla, 542 U.S. 426, 442 (2004); Ezeigwe v. Holder, No. 12-cv-2200, 2012 WL 1965403, at *2 (E.D.N.Y. May 29, 2012). Here, the Court lacks jurisdiction to adjudicate petitioner's claims as he is presently confined in the Western District of Pennsylvania. 28 U.S.C. 118. The Court also notes that petitioner was convicted and sentenced in the Eastern District of Pennsylvania. See Williams v. Rozum, No. 07-3716-PBT, slip op. (E.D. Pa. Sept. 9, 2008). Accordingly, this petition is hereby transferred to the United States District Court for the Western District of Pennsylvania pursuant to Local Rule 83.3 of the Eastern District of New York.
