Filing 2 ORDER that the Clerk of Court is to mark this case CLOSED. Pro se Plaintiff Martin E. Vigne filed a complaint on behalf of himself individually and as trustee of Martin E. Vigne Family Trust (the "Trust") without filing a motion to proceed in forma pauperis or paying the applicable filing fee. While an individual may represent himself pro se, a non-attorney may not represent other parties in federal court. Custer v. Green, No. 23-cv-1903, 2023 WL 8358123, at *1 (E.D. Pa. Dec. 1, 2023). Further, only a natural person may qualify for treatment in forma pauperis. Johnson v. Scharf, No. 23-cv-4211, 2023 WL 7532488, at * 1 (E.D. Pa. Nov. 13, 2023). Mr. Vigne cannot represent the Trust; the Trust would need to retain counsel. In re Olick, 571 F. App'x 103, 106 (3d Cir. 2014) (holding pro se plaintiff "may not represent the Trust in federal court because he is not an attorney and without counsel the Trust may not appear in federal court"). Accordingly IT IS HEREBY ORDERED that Plaintiff MARTIN E. VIGNE must either (1) pay the $405.00 filing fee, which will reopen his case, or (2) submit a motion to proceed in forma pauperis using civil form AO 239 Application to Proceed in District Court Without Prepaying Fees or Costs (Long Form), which is available on the Court's website at https://www.uscourts.gov/forms/civil-forms. If that motion to proceed in forma pauperis is granted, the case will be reopened. Signed by Judge Christy Criswell Wiegand on 2/9/2024. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bjw) |
