December 18, 2019 Opinion or Order Filing 19 ORDER re #17 correspondence from Plaintiff dated December 8, 2019. Plaintiff states that he has ascertained the names of the two John Doe Defendants. The Clerk of Court is directed to change the docket to reflect that John Doe #1 is CO Garrison and John Doe #2 is CO Strait. Order re #18 correspondence from Plaintiff dated December 9, 2019. Plaintiff states that he received his receipt for the payment of the $350.00 filing fee and wants to know whether he owes another $50.00 for the administrative fee. Because Plaintiff was granted leave to proceed in forma pauperis, he does not have to pay the $50.00 administrative fee. Plaintiff also wants to know what he must do "to keep this claim moving." Plaintiff is directed to refer to the Standing Practice Order that was mailed to him at the beginning of this case. At this time, there is nothing further for Plaintiff to do until further order of Court. If Plaintiff's case survives initial screening then the Court will direct the USMS to serve the Defendants with the Complaint. After they are served they will answer or otherwise respond to the Complaint. Once again, Plaintiff is directed to not send correspondence as it likely will not be docketed or responded to by the Court. If he desires action by the Court on a particular matter then he is directed to make his request in the form of a motion. While it does appear that Plaintiff attempted to do this in his two letters, he did not include a title indicating what action/relief he was requesting from the Court. Again, Plaintiff is directed to refer to the Standing Practice Order that was mailed to him at the beginning of this case. October 28, 2019 Opinion or Order Filing 2 ORDER granting #1 Plaintiff's Motion for Leave to Proceed in forma pauperis to the extent that the case may proceed without the prepayment of the entire filing fee. Plaintiff shall pay $15.09 as an initial partial filing fee as provided by 28 U.S.C. 1915(b)(1)(A); however, he is still assessed the total $350.00 filing fee. The agency having custody of Plaintiff shall forward, within THIRTY (30) DAYS from the date of this Order, the initial partial filing fee of $15.09 to the Clerk of Court. After payment of the initial partial filing fee, Plaintiff shall be required to make monthly payments of twenty percent of the preceding month's income (that is, all funds deposited into the account) credited to the account. Plaintiff is warned that he is ultimately responsible for payment of the filing fee if the agency with custody over him lapses in its duty to make payments on his behalf. The Clerk of Court shall mail a copy of this Order to the Inmate Account Officer at Plaintiff's place of confinement. The Clerk of Court shall enclose an authorization form which Plaintiff shall complete and return within ten (10) days of this Order. If the initial partial filing fee of $15.09 is not received within THIRTY (30) DAYS from the date of this Order then this action may be dismissed for Plaintiff's failure to prosecute.
