OPINION AND ORDER re 2 Motion for Preliminary Injunction; re 28 Motion to Dismiss for Failure to State a Claim; and re 44 Motion for Summary Judgment. The Court GRANTS defendants' motion to dismiss the wheelchair access claim, (Docket No. 28). The wheelchair access claim, brought pursuant to the IDEA and the ADA, is DISMISSED WITHOUT PREJUDICE. With respect to plaintiffs' transportation reimbursement claim, the Court DENIES defendants' motion to dismiss, (Docket No. 28), and HOLDS IN ABEYANCE plaintiffs' unopposed motions for a preliminary injunction, (Docket No. 2), and for summary judgment, (Docket No. 44).
